1 – Introduction

By using or visiting the website hosted at https://valedaspapas.pt/ (“Site”) or any of the information, data files, written text, graphics, links, audio files or other sounds, photographs, videos, or other images (collectively, “Content”), resources, and services, including the newsletter (collectively, including the Content, the “Services”) made available through it, you, as a user or visitor of the same (“User”), agree to and accept:

1. these Terms and Conditions (“Terms and Conditions”);
2. the Privacy and Personal Data Protection Policy available in the Privacy Policy.

Through the Site, Vale das Papas provides the User with access to the Services, including updates, developments, new tools, and/or new web properties, which are subject to these Terms.

2 – General Obligations and Responsibilities of the User

• The User agrees to use the Site only for its intended purposes, complying with all applicable laws.
• Automated access (scripts, crawlers) and the introduction of viruses or harmful software are prohibited.
• User Account: To access certain Services, the User may be required to provide valid personal data. The User is responsible for the confidentiality of the password and the use of the Account and must immediately notify Vale das Papas of any unauthorized use.
• The User is responsible for any damage caused through the misuse of the Site or their Account.

3 – Rights and Obligations of Vale das Papas

• To modify, add to, or remove parts of the Terms and Conditions.
• To modify or terminate the Services, in whole or in part, without prior notice.
• To remove User Accounts whose content violates rights or is illegal.
• To provide technical support by email for registered users.

4 – Intellectual Property and Personal Rights

• All content on the Site is the property of Vale das Papas or of third parties properly identified.
• The User may not copy, modify, create derivative works, or attempt to extract source code without authorization.
• Trademarks, logos, and other brand features are the property of Vale das Papas and may not be used without permission.

5 – Disclaimer of Warranties

• The services are provided “as is” and “as available.”
• Vale das Papas does not guarantee that the use of the services will meet the User’s expectations, nor that it will be continuous or error-free.
• The User assumes all risks associated with the use of the Site and the services.

6 – Limitation of Liability

• Vale das Papas is not responsible for damages resulting from advertising or relationships with third-party advertisers.
• Changes to or termination of the services.
• Loss or corruption of data.
• Misuse of the Account by the User.
• Circumstances beyond the company’s control (force majeure, technical failures).

7 – General Booking Conditions

7.1 Scope

These General Conditions govern the contract for the provision of accommodation booking and tourist services through the Site.

7.2 Bookings

• O Cliente deve fornecer dados completos e corretos.
• Upon confirming the reservation, you will receive a booking code that must be used in all communications.
• For transportation bookings or required documents, the client is responsible for obtaining them.

7.3 Benefits, promotions, and discounts

• Promotions and discounts are subject to availability and confirmation.
• They may require a promotional code or advance payment.
• Any fraudulent use will invalidate the discount.

7.4 Taxes and fees

• Prices include legally applicable taxes.
• Booking, change, or cancellation fees may apply as described in the reservation.

7.5 Reservation changes

• Changes are subject to the express agreement of Vale das Papas.

8 – Accommodation

• Casa da Vinha: always rented in its entirety, maximum 10 guests (children up to 2 years old in a crib do not count).
• Casa do Olival: cannot be reserved separately; it complements Casa da Vinha for groups of 11-12 people.
• Casa do Rochedo:  cannot be reserved separately; it complements Casa da Vinha + Casa do Olival for groups of 13-14 people.
• Configuração de camas:
  • Casa da Vinha: 2 double beds + 3 single beds that can be converted into double beds.
  • Casas do Olival and Rochedo: 1 double bed each.
• Included services:
  • Breakfast included.
  • Outdoor pool, spa (sauna, steam room, jacuzzi), leisure room with pool table and ping-pong.
  • Covered dining area with barbecue.
  • Option to arrange additional meals (to be arranged at the time of booking).
• Hours:
  • Check-in: from 4:00 PM.
  • Check-out: by 11:00 AM.
• Minimum stay: 2 nights (high season: 3 nights).

  • Via Alijó – Easiest route
  • Via Peso da Régua – Scenic route

9 – Payment

• Pagamento por transferência bancária (enviar comprovativo para booking@valedaspapas.pt).
• Reservation is confirmed only after payment validation.

10 – Cancellation

• Free cancellation up to 15 days before check-in (except during high season: up to 4 weeks before check-in).
• Cancellation after the specified periods or no-show: total amount of the stay is non-refundable.
• Cancellation must be made by phone (+351 91 40 52 276) or email (booking@valedaspapas.pt).

11 – Security deposit

• A security deposit of €1000 is required for each reservation to cover potential damages or losses to the property or provided items.
• The amount is refunded after the stay and the inspection of the property’s condition and the provided items.

12 – Inability to comply

Vale das Papas will immediately notify if it is unable to fulfill its obligations due to factors beyond its control. The client may either terminate the contract or accept the proposed changes.

13 – Complaints

• Complaints must be submitted in writing, preferably during the stay or within 20 working days after the end of the stay.
• Supporting documents of the occurrence are required.
• The complaint may trigger the use of the security deposit, in accordance with applicable legislation.

14 – Liability

• Vale das Papas is only liable for willful misconduct or gross negligence.
• It is not responsible for acts of third parties or external causes (force majeure, technical failures, transportation delays, lost luggage).

15 – Personal data

Data collected in the booking form will be processed in accordance with the Privacy Policy.

17 – General provisions

• The Specific Booking Conditions take precedence over these General Terms and Conditions.
• Any amendment to the contract must be made in writing and signed by both the Client and Vale das Papas.
• Vale das Papas may change these conditions for future legal relationships without prior notice.

18 – Applicable law and jurisdiction

• The contract is governed by the laws of the Portuguese Republic.
• Competent jurisdiction: Court of the Vila Real District.
• The consumer may resort to the European Online Dispute Resolution Platform: http://ec.europa.eu/consumers/odr or to the consumer arbitration entities listed in the original text.
